TERMS AND CONDITIONS FOR ONLINE SALE OF MEMBERSHIP FEES AND ANGLING PERMITS
OF THE REGIONAL BOARD OF THE POLISH ANGLING ASSOCIATION IN SŁUPSK

§1 Dictionary

Online sales conducted through the website – the ability to sell and purchase products via the internet.
Website –  a web page created and made available at the following address: https://pzw.slupsk.pl/c/zezwolenia/.
Membership fee, permit – a document that confirms authority to recreational fishing on the waters of the District Board of the Polish Angling Association in Słupsk.
Seller – Regional Board of the Polish Angling Association in Słupsk Al. 3-go Maja 65A tel. (0-59)8436341 e-mail: kontakt@pzw.slupsk.pl, NIP: 8392453521, REGON: 770957820, KRS 0000083073.
Commision – a payment processing fee charged for the execution of the transaction via the service, payable to PayPro S.A. (PayPro) – the online payment operator – by the Seller.
Electronic payment operator – PayPro S.A. (PayPro), based in Poznań, providing the payment management service available at www.przelewy24.pl

 

§2 Online sales
  1. The online sales of permits and membership fees is conducted via website.
  2. The online sale of the Seller’s membership fees and angling permits is carried out via the electronic payment operator.
  3. The sales agreement between the Buyer and the Seller is concluded upon the fulfillment of the required purchase procedures for the Seller’s membership fees and permits, as described on the Website:
    a) placement of an online order by the Buyer,
    b) payment by the Buyer for the order via the Website using any available electronic payment channel.
  4. The purchase of the Seller’s membership fees and angling permits constitutes acceptance of these Terms and Conditions, as well as the current rules of the Seller’s recreational fishing regulations available at https://pzw.slupsk.pl
  5. A 5% fee is charged for each payment made via the website. This fee is payable to PayPro S.A. (PayPro) by the Seller and is related to the maintenance of the website, servers, and operational and financial costs associated with operating the online service.
  6. Payments for membership fees and permits are processed by PayPro SA (PayPro), based in Pozań, via the payment management platform www.przelewy24.pl
  7. The Seller is not liable for any consequences resulting from malfunctions or irregularities in the functioning of the payment platform www.przelewy24.pl.
    Credit card and online bank transfer transactions are processed via PayPro SA (PayPro).
  8. In accordance with the Regulation of the Minister of Finance dated July 26, 2010, the sale of memberships and permits ordered and paid for online is not subject to fiscalization, and therefore the Buyer does not receive a fiscal receipt.
  9. To receive an invoice for the purchased memberships/permits, the Buyer must send a request to the email address kontakt@pzw.slupsk.pl after receiving the permit, providing the order number. The invoice will be issued based on the information provided in the order.
  10. Persons making payments via a foreign bank should take into account any intermediary banking fees. Only full payment made within the designated time frame guarantees the execution of the order by the Seller.
  11. All membership fees and permits purchased through the membership/permit sales platform are issued in the buyer’s name. Before making a payment, it is mandatory for the owner of the memberhship fee and permit to give their name and last name.
  12. Membership fees and named permits for Polish citizens, who do not hold a fishing license or a PZW membership card (for registered members of the Polish Angling Association – PZW) are invalid.
  13. The seller has a right to terminate online sales at any moment without providing a reason.
  14. The seller is not responsible for the consequences of giving false or incorrect information by the purchaser in an order form.
  15. After making the payment, the Buyer will promptly receive the membership and permit in electronic form at the email address provided when placing the order. The Buyer is obliged to print the membership and permit. Failure to present the membership and permit may result in a penalty for the angler.

 

§3 Complaints, returns, and exchanges of memberships/permits
  1. In justified cases, the Seller will accept returns of permits and refund the amount paid. Buyer complaints will be processed promptly, but no later than within 7 business days from the date of submission to the Seller’s email address. In exceptional situations, the complaint processing period may be extended, about which the Buyer will be informed. The person submitting the complaint will be notified of the complaint resolution in the same manner and to the email address provided in the complaint.
  2. Returns/complaints regarding permits can only be made electronically via email at kontakt@pzw.slupsk.pl. If the return/complaint is resolved in favor of the Buyer, the Seller will refund the amount paid, subject to §3 section 3 of these Terms and Conditions.
  3. In case of a permit return, the Buyer is entitled to a refund of the amount paid as follows:
    a. 100% of the purchased permit’s value, for reasons not attributable to the Buyer, for which the Buyer is not responsible, subject to §5 section 2 of these Terms and Conditions;
    b. 50% of the purchased permit’s value if the return is made at least 40 days before the date the permit was to be used;
    c. 40% of the purchased permit’s value if the return is made between 39 and 21 days before the date the permit was to be used;
    d. 20% of the purchased permit’s value if the return is made less than 21 days before the date the permit was to be used.
  4. Unused permits that have expired are not subject to refund or date change.
  5. It is not possible to change the validity period of the permit.
  6. When making a return/complaint of purchased permits, it is mandatory to provide: transaction number, permit number, validity date of the membership/permit, and the name of the purchaser. Credit card and online bank transfer transactions are processed via PayPro SA (PayPro) or to the bank account provided when submitting the complaint.

 

§4 Buyer data protection
  1. In accordance with Article 23(1)(3) of the Act of August 29, 1997 on the Protection of Personal Data (Journal of Laws 2016, item 195, as amended), by registering on the online sales platform, the Buyer consents to the storage and processing of their personal data by the operator for the purpose of fulfilling the order, necessary contact with the Buyer, and any actions required for the functioning of the service.
  2. The storage and processing of personal data received are carried out in compliance with the provisions of the Personal Data Protection Act (Journal of Laws 2018, item 1000) and the Act of July 18, 2002 on the Provision of Electronic Services (Journal of Laws 2017, item 1219, as amended).
  3. Pursuant to the Personal Data Protection Act (Journal of Laws 2018, item 1000), the data controller is the Management Board of the District of the Polish Angling Association, with its registered office in Słupsk, which processes data for the purpose of contract execution. Every data subject has the right to obtain information about the principles of data processing, control, correction, and protection.

§5 Final provisions
  1. Membership fees and permits bought via a website may not be copied.
  2. The seller shall not be held responsible for the functioning of the Internet network through which the Buyer purchases memberships and permits. The Seller is not responsible for messages or other data lost or corrupted on the Internet, individual computer settings, their configuration, settings, or interruptions in service experienced by Internet service providers, nor for the operations of banks through which payments for purchased memberships and permits to the seller are made.
  3. These Online Sales Terms and Conditions are available on the Website.
  4. The Seller is authorized to amend these Terms and Conditions at any time.
  5. Pursuant to Article 38(12) of the Consumer Rights Act (Journal of Laws 2017, item 683, as amended), the Buyer does not have the right to withdraw from a contract concluded outside the business premises or at a distance.
