with its registered office in Słupsk at 65/A 3 Maja Street, 76-200 Słupsk, acting pursuant to: Article 3 of the Act
of 29 January 2004 – Public Procurement Law (consolidated text: Journal of Laws of 2018, item 1986) as an entity not obliged to apply it, and the Rules for the competitive selection of contractors under the ‘Fisheries and Sea Operational Programme 2014–2020’ in connection with the signed grant agreement
No. 00034-6521.3.1-OR1100027/21 of 1 September 2021, concluded between the Agency for Restructuring and Modernisation of Agriculture, with its registered office in Warsaw, and the Management Board of the Słupsk District of the Polish Angling Association, entitled: ‘Modernisation and equipping of the Fish Stocking Centre in Damnica’

for the submission of a quotation for the purchase and delivery of a workbench for the Fish Stocking Centre in Damnica, Osiedle Rybackie Street, as part of the project entitled “Modernisation and equipping of the Fish Stocking Centre in Damnica”

4. Conditions for participation in the procurement procedure required of contractors (information on the exclusion of entities linked by personal or capital ties from being awarded the contract).

An entity submitting a tender in this procedure, hereinafter referred to as the ‘Supplier’ in this invitation to tender, must not be personally or financially linked to
the ‘Contracting Authority’.

A capital or personal link is understood to mean a mutual link between the ‘Contracting Authority’ or persons authorised by the ‘Contracting Authority’ to enter into commitments on behalf of the ‘Contracting Authority’ or persons performing activities on behalf of the ‘Contracting Authority’ relating to
the conduct and implementation of the ‘Supplier’ selection procedure, and the ‘Supplier’, consisting in particular of:

• participation in a company as a partner in a civil law partnership or a partnership,
• holding at least 10 per cent of the shares,
• serving as a member of a supervisory or management body, a proxy or an authorised representative,
• being married to, or having a relationship of kinship or affinity in the direct line, kinship or affinity in the collateral line up to the second degree, or a relationship of adoption, guardianship or custody.

The content of the declaration attached to the tender must clearly indicate that the contractor meets the above conditions. Otherwise, should a request to supplement the declaration prove unsuccessful, the contracting authority will exclude the contractor from the procedure.

5. 5. When selecting a tender, the contracting authority will be guided by the following criteria:

    Lowest tender price – 100%

6. The tender must be accompanied by:

The contracting authority imposes no requirements in this regard.

7. Description of how the tender price is calculated:

The tender price must be specified as a lump sum, which should cover all costs and components associated with the performance of the supply as set out in the description of the subject matter of the contract, including, amongst others: VAT, overheads, delivery to the place of delivery, etc.

8. Description of how to prepare the tender:

8.1. It must be submitted in an opaque, sealed envelope,

8.2. The envelope must bear the name and address of the ‘Contracting Authority’, the name and address of the ‘Supplier’, and the following wording:

“Modernisation and equipping of the Fish Stocking Centre in Damnica – do not open before 20 July 2023 at 10.15”

8.3. The tender must be drawn up in Polish, using legible and durable writing; the price quoted in the tender must be expressed both in figures and in words.

9. Place and deadline for submission of the tender:

The tender must be submitted by 10.00 on 20 July 2023 in a sealed envelope,
at the “Contracting Authority’s” registered office, i.e. at the headquarters of the Management Board of the Polish Angling Association, ul. 3-go Maja 65/A, 76-200 Słupsk, secretariat.

Any tender submitted after the deadline will be returned to the ‘Supplier’ unopened. The ‘Supplier’ may amend or withdraw their tender before the deadline for submission expires.

The opening of the tenders submitted will take place on 20 July 2023, at 10.15 am at the “Contracting Authority’s” premises at the headquarters of the Management Board of the Polish Angling Association, ul. 3-go Maja 65/A, 76-200 Słupsk – the Management Board’s meeting room

13. Information regarding the conclusion of the contract:

The contract will be concluded with the ‘Supplier’ whose tender offers the lowest price, immediately following notification of the selection of the most advantageous tender.

14. Other information

15.1. The Contracting Authority does not envisage:

1. a) settlement in a currency other than the Polish zloty,
2. b) reimbursement of costs incurred in participating in the procedure.

15.2. The Contracting Authority reserves the right to cancel the tender procedure, in particular where:

• if fewer than two tenders compliant with the invitation to tender are submitted,
• circumstances arise which could not have been foreseen at the time the tender procedure was launched.
